Section 1.            Introduction.

(a)            Know Fun LLC, a limited liability company organized under the laws of the State of Delaware in the United States of America (“Company”) respects your privacy and is committed to protecting it through the Company’s compliance with this Privacy Policy and applicable laws.

(b)           This Privacy Policy describes the types of information the Company may collect from you or that you may provide when you visit, register by creating a user account (“Account”), or otherwise view or use the online services the Company provides from time to time (“Services”) through the Company’s websites, mobile versions, downloadable apps, and platforms (collectively, the “Facilities”). This Privacy Policy also describes the Company’s practices for collecting, using, maintaining, protecting, and disclosing that information.

(c)            This Privacy Policy applies to individuals and entities who or which visit the Facilities, create an Account, or otherwise view or use the Services (“Users”) irrespective of their location or place of residence.

(d)           Please read this Privacy Policy carefully to understand the Company’s policies and practices regarding your information and how it will be treated. If you do not agree with this Privacy Policy, your choice is not to use the Services. By accessing or using the Services and Facilities, you agree to this Privacy Policy. This policy may change from time to time (see Section 13 below). Your continued use of the Services and Facilities after changes are made to the Privacy Policy is deemed to be your acceptance of those changes, so please routinely check the Privacy Policy for updates.

Notice for Residents of the State of California

(e)            This Privacy Policy also applies to all Users who reside in the State of California. The Company adopts this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and any terms defined in the CCPA have the same meaning when used in this notice. In addition to the general provisions set forth in Section 1 through to Section 14, please see the additional provisions applicable to Users who are resident in California set forth in Section 15 through to Section 20.

Notice for Residents of the European Union

(f)            This Privacy Policy also applies to all Users who reside in the European Union. In addition to the general provisions set forth in Section 1 through to Section 14, please see the additional provisions applicable to Users who are resident in the European Union set forth in Section 21 through to Section 23.

Section 2.            Minors.

(a)            The Services are intended only for individuals who are at least eighteen (18) years of age, or such higher age as may be imposed by the Company or the laws of any country in which you are located. The Company does not knowingly collect information from persons under eighteen (18) years of age. If you are under eighteen (18) years of age, please do not use the Services or Facilities and please do not provide any information to the Company.

(b)           If the Company learns that it has collected or received Personal Information from a child under eighteen (18) years of age without verification of parental consent, the Company will delete that information. If you believe the Company might have any information from or about a child under eighteen (18) years of age, please contact the Company by any of the following means:

Section 3.            Information the Company Collects.

(a)            The Services and Facilities collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device. In particular, the Services and Facilities collect, and have within the last twelve (12) months, collected the following categories of information (collectively, “Personal Information”):

(b)           With respect to Category L: Sensitive personal information, the Company collects the following types of sensitive Personal Information (“Sensitive Personal Information”):

(i)             a User’s Social Security number when necessary for reporting to tax authorities the User’s taxable income from the Services; and

(ii)           a consumer’s precise geolocation for the purposes of establishing any laws applicable to the User.

(c)            Personal information does not include:

(i)             publicly available information from government records;

(ii)           deidentified or aggregated consumer information;

(iii)         health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data; or

(iv)          personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

(d)           The Company obtains the categories of Personal Information listed above from the following categories of sources:

(i)             directly from you when you confirm your age or set up an Account;

(ii)           directly from you when you use the Services, enter a search query through the Services, subscribe to a Service, create or join a collaboration group, post Content or Comments, respond to a survey, enter a contest or promotion, or use a discount coupon or QR code;

(iii)         directly from you when you interact with the Company’s employees whether by phone, mail, email, instant messaging, the Services, or other means;

(iv)          indirectly from you when you connect to the Services and Facilities including information about your computer and internet connection, including your IP address, operating system, and browser type;

(v)           indirectly from you when you access and use the Services including traffic data, location data, logs, searches, and other communication data and the resources that you access and use;

(vi)          indirectly from you by observing your actions on the Services, when you interact with advertisers on the Services, or when you interact with the Company’s advertisements on third party sites or apps; and

(vii)        from third parties such as the Company’s Payment Processor or any business used to verify a User’s age.

Section 4.            Use of Personal Information

(a)            The Company may use and disclose Personal Information collected for one or more of the following business purposes (each a “Business Purpose”):

(i)             auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards;

(ii)           helping to ensure security and integrity to the extent the use of the User’s Personal Information is reasonably necessary and proportionate for these purposes;

(iii)         debugging to identify and repair errors that impair existing intended functionality of the Services and Facilities;

(iv)          short-term, transient use, including, but not limited to, nonpersonalized advertising shown as part of a User’s current interaction with the Company, Services, or Facilities, provided that the User’s Personal Information is not disclosed to another third party and is not used to build a profile about the User or otherwise alter the User’s experience outside the current interaction with the Company, Services, and Facilities;

(v)           performing Services, including maintaining or servicing Accounts, providing customer service, processing or fulfilling orders and transactions, verifying User information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on behalf of the Company;

(vi)          providing advertising and marketing services, except for cross-context behavioral advertising, to the User;

(vii)        undertaking internal research for technological development and demonstration;

(viii)      undertaking activities to verify or maintain the quality or safety of the Services or Facilities, and to improve, upgrade, or enhance the Services or Facilities;

(ix)          complying with federal, state, or local laws or comply with a court order or subpoena to provide information;

(x)           complying with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities;

(xi)          cooperating with law enforcement agencies concerning conduct or activity that the business, service provider, or third party reasonably and in good faith believes may violate federal, state, or local law;

(xii)        cooperating with a government agency request for emergency access to a consumer’s Personal Information if a natural person is at risk or danger of death or serious physical injury;

(xiii)      exercising or defending legal claims and actions;

(xiv)       collecting, using, retaining, selling, sharing, or disclosing Users’ Personal Information that is deidentified or aggregate consumer information; and

(xv)        evaluating or conducting a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding (“Corporate Transaction”), in which Personal Information held by us is among the assets transferred.

(b)           The Company uses the following types of Sensitive Personal Information for the purposes indicated below:

(i)             a User’s Social Security number when necessary for reporting to tax authorities the User’s taxable income from the Services; and

(ii)           a consumer’s precise geolocation for the purposes of establishing any laws applicable to the User; complying with federal, state, or local laws or comply with a court order or subpoena to provide information; complying with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities; cooperating with law enforcement agencies concerning conduct or activity that the business, service provider, or third party reasonably and in good faith believes may violate federal, state, or local law; cooperating with a government agency request for emergency access to a consumer’s Personal Information if a natural person is at risk or danger of death or serious physical injury; and exercising or defend legal claims and actions.

(c)            The Company will not collect additional categories of Personal Information or use the Personal Information collected for materially different, unrelated, or incompatible purposes without providing you notice.

Section 5.            Sharing Personal Information

(a)            The Company may disclose your Personal Information to a third party for a Business Purpose. When the Company discloses Personal Information for a Business Purpose, the Company enters a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except performing the contract. 

(b)           The Company shares your Personal Information with the following categories of third parties:

(i)             businesses that display your cookie options and log your selections;

(ii)           businesses that provide database storage services to the Company;

(iii)         businesses that provide web analytics services to the Company;

(iv)          businesses which advertise on the Services;

(v)           businesses which provide email marketing services to the Company;

(vi)          to tax authorities to report any income paid to you;

(vii)        to law enforcement and governments pursuant to legal requests; and

(viii)      potential counter-parties to a Corporate Transaction.

(c)            The Company shares the following types of Sensitive Personal Information for the purposes indicated below:

(i)             a User’s Social Security number when necessary for reporting to tax authorities the User’s taxable income from the Services; and

(ii)           a consumer’s precise geolocation for the purposes of complying with federal, state, or local laws or comply with a court order or subpoena to provide information; complying with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities; cooperating with law enforcement agencies concerning conduct or activity that the business, service provider, or third party reasonably and in good faith believes may violate federal, state, or local law; cooperating with a government agency request for emergency access to a consumer’s Personal Information if a natural person is at risk or danger of death or serious physical injury; and exercising or defend legal claims and actions.

(d)           All payment and subscription transactions are handled by the Company’s Payment Processor which will collect bank account numbers, credit card numbers, debit card numbers, names, addresses, and other contact information necessary to process the payment or subscription transaction. The Company does not collect or store bank account numbers, credit card numbers, or debit card numbers.

Section 6.            Disclosures of Personal Information for a Business Purpose

(a)            In the preceding twelve (12) months, Company has disclosed the following categories of Personal Information for a Business Purpose:

Category A: Identifiers.

Category B: California Customer Records Personal Information categories.

Category D: Commercial information.

Category F: Internet or other similar network activity.

Category L: Sensitive personal information.

 

(b)           The Company disclosed your Personal Information for a Business Purpose to the following categories of third parties:

(i)             businesses that display your cookie options and log your selections;

(ii)           businesses that provide database storage services to the Company;

(iii)         businesses that provide web analytics services to the Company;

(iv)          businesses which advertise on the Services;

(v)           businesses which provide email marketing services to the Company;

(vi)          to tax authorities to report any income paid to you; and

(vii)        to law enforcement and governments pursuant to legal requests.

(c)            Note that the Company shares anonymized information, in both individual and aggregate forms with its advertisers and with businesses providing web analytics services.

Section 7.            Sales of Personal Information

(a)            The Company has not, and does not, sell Personal Information including Sensitive Personal Information.

(b)           The Company has no plans to sell any Personal Information including Sensitive Personal Information.

Section 8.            Holding Period of Personal Information.

(a)            With respect to Sensitive Personal Information, the Company shall hold such Sensitive Personal Information as follows:

(i)             with respect to a User’s Social Security number, for such period as required to report income and other amounts to applicable tax authorities and for such time thereafter as may be required by law; and

(ii)           the User’s precise geolocation for such time as the User accesses or uses the Services and Facilities and for such time thereafter as needed for the Company to comply with local laws, court orders, subpoenas, summons, inquiries, investigations, claims, and actions.

(b)           With respect to all other types of Personal Information, for such time as the User maintains an Account and for a period of time thereafter consistent with industry-standard best practices for the retention of such Personal Information.

Section 9.            Third-Party Use of Cookies and Other Tracking Technologies

(a)            Some advertisements on the Services are provided by other Users or by third parties. These other Users and third parties may use cookies, with web beacons, or other tracking technologies to collect information about you when you use the Services. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

(b)           The Company does not control the tracking technologies used by other Users and third parties. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

Section 10.         Correcting and Deleting Your Information

(a)            You may correct any of your Personal Information stored in your Account at any time. You may also delete your Account at any time.

(b)           Note that the Company will store your historic and deleted Personal Information and other Account information after such change or deletion as follows:

(i)             in accordance with industry-standard best practices for the retention of Personal Information;

(ii)           to comply with federal, state, or local laws or comply with a court order or subpoena to provide information;

(iii)         to comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities;

(iv)          to cooperate with law enforcement agencies concerning conduct or activity that the business, service provider, or third party reasonably and in good faith believes may violate federal, state, or local law;

(v)           to cooperate with a government agency request for emergency access to a consumer’s personal information if a natural person is at risk or danger of death or serious physical injury;

(vi)          to exercise or defend legal claims and actions; and

(vii)        to evaluate or conduct a Corporate Transaction.

Section 11.         Your Content and Comments.

(a)            The Services provide you with the ability to upload or post (i) written, text, software, audio, sound, visual, graphic, pictorial or other materials or content including, without limitation, advertising (“Content”) and (ii) messages, advice, offers, ratings, reviews, comments, or other similar communications (collectively, “Comments”).

(b)           All Content and Comments you upload or post is at your own risk.

(c)            DO NOT INCLUDE ANY SENSITIVE PERSONAL INFORMATION IN YOUR CONTENT AND COMMENTS. Be cautious about including any other Personal Information in your Content and Comments. The Company cannot monitor all Content and Comments, and disclaims any responsibility for reviewing Content and Comments for Personal Information or for removing or redacting Personal Information from Content and Comments.

(d)           Please be aware that unscrupulous persons may use information obtained from Content and Comments to target you for scams, fraud, or other harmful activity. The Company cannot control the actions of third parties who may target you.

(e)            For those Services which allow you to delete Content or Comments, note that if you delete your Content or Comments from the Services, copies of your Content or Comments may remain viewable in cached and archived pages, or might have been copied or stored by other Users. The Company may also store your Content and Comments, whether or not deleted from the active Services, as follows:

(i)             in accordance with industry-standard best practices for the retention of Content and Comments;

(ii)           to comply with federal, state, or local laws or comply with a court order or subpoena to provide information;

(iii)         to comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities;

(iv)          to cooperate with law enforcement agencies concerning conduct or activity that the business, service provider, or third party reasonably and in good faith believes may violate federal, state, or local law;

(v)           to cooperate with a government agency request for emergency access to a consumer’s personal information if a natural person is at risk or danger of death or serious physical injury;

(vi)          to exercise or defend legal claims and actions; and

(vii)        to evaluate or conduct a Corporate Transaction.

Section 12.         Data Security.

(a)            The Company has implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide is stored on secure servers behind firewalls.

(b)           The safety and security of your Personal Information, Content, and Comments also depends on you. You are responsible for creating a complex and secure password and keeping it confidential. You must not share your password with anyone.

(c)            The Company urges you to be careful about giving out information in public areas of the Services. Please be aware that unscrupulous persons may use information obtained from Content and Comments to target you for scams, fraud, or other harmful activity. The Company cannot control the actions of third parties who may target you.

Section 13.         Changes to this Privacy Policy

(a)            The Company reserves the right to change this Privacy Policy at any time and from time to time. When changed, the Company will post notice that the Privacy Policy has been changed on the Services or provide notice by email to the email address identified in your Account. You are responsible for ensuring that the email address identified in your Account is active.

(b)           The date the Privacy Policy was last revised is identified at the beginning.

(c)            Your continued use of the Services or further communication with the Company following notice of change constitutes your acceptance of such change.

Section 15.         Introduction.

(a)            If you are a California resident, California law may provide you with additional rights regarding the Company’s use of your Personal Information. To learn more about your California privacy rights, please review the following provisions of this Privacy Policy which act in conjunction with the foregoing provisions of this Privacy Policy.

(b)           California’s “Shine the Light” law (Civil Code Section § 1798.83) permits Users that are California residents to request certain information regarding the Company’s disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an email to legal@know.fun.

(c)            The provisions of Section 15 through Section 20 of this Privacy Policy do not apply to Users who are not resident in California.

Section 16.         Your Rights and Choices

(a)            The CCPA provides California residents with specific rights regarding their Personal Information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

(b)           You have the right to request that the Company disclose certain information to you about the Company’s collection and use of your Personal Information over the past twelve (12) months. Once the Company receives and confirms your verifiable consumer request (see the heading Exercising Access, Data Portability, and Deletion Rights below), the Company will disclose the following to you:

(i)             the categories of Personal Information the Company collected about you;

(ii)           the categories of sources for the Personal Information the Company collected about you;

(iii)         the Company’s business or commercial purpose for collecting or selling that Personal Information;

(iv)          the categories of third parties with whom the Company share that Personal Information;

(v)           the specific pieces of Personal Information the Company collected about you (also called a data portability request); and

(vi)          if the Company sold or disclosed your Personal Information for a business purpose, two separate lists disclosing: sales, identifying the Personal Information categories that each category of recipient purchased; and disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

Deletion Request Rights

(c)            You have the right to request that the Company delete any of your Personal Information collected from you and retained by the Company, subject to certain exceptions. Once the Company receives and confirms your verifiable consumer request (see the heading Exercising Access, Data Portability, and Deletion Rights below), the Company will delete (and direct the Company’s service providers to delete) your Personal Information unless an exception applies.

(d)           The Company may deny your deletion request if retaining the information is necessary for the Company or its service provider(s) to do any of the following:

(i)             complete the transaction for which the Company collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of the Company’s ongoing business relationship with you, or otherwise perform the Company’s contract with you;

(ii)           detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;

(iii)         debug products to identify and repair errors that impair existing intended functionality;

(iv)          exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;

(v)           comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.);

(vi)          engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent;

(vii)        enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;

(viii)      comply with a legal obligation; or

(ix)          make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Correction Request Rights

(e)            As a general matter, you may correct any of your Personal Information stored in your Account at any time. To the extent that you may not correct your Personal Information voluntarily, you have the right to request that the Company correct any of your Personal Information that it collected from you and retained, subject to certain exceptions. Once the Company receives and confirms your verifiable consumer request (see the heading Exercising Access, Data Portability, and Deletion Rights below), the Company will correct (and direct the Company’s service providers to correct) your Personal Information unless an exception applies.

(f)            The Company may deny your correction request under the following circumstances:

(i)             the new information supplied is inconsistent with identification documents;

(ii)           the Company has reasonable grounds for believing that the new information is incorrect; or

(iii)         the correction is intended to have retroactive effect for records that cannot be retroactively amended.

Exercising Access, Data Portability, and Deletion Rights

(g)           To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

(h)           Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

(i)             You may only make a verifiable consumer request for access or data portability twice within a twelve (12) month period. The verifiable consumer request must:

(i)             provide sufficient information that allows us to reasonably verify you are the person about whom the Company collected Personal Information or an authorized representative; and

(ii)           describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

(j)             The Company cannot respond to your request or provide you with Personal Information if the Company cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.

(k)           Making a verifiable consumer request does not require you to create an Account with us. However, the Company considers requests made through your password protected Account sufficiently verified when the request relates to Personal Information associated with that specific Account.

(l)             The Company will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Section 17.         Response Timing and Format

(a)            The Company endeavors to respond to a verifiable consumer request within forty-five (45) days of its receipt. If the Company requires more time (up to 90 days), the Company will inform you of the reason and extension period in writing.

(b)           If you have an Account with us, the Company will deliver its written response to that Account. If you do not have an Account with the Company, it will deliver a written response by mail or electronically, at your option.

(c)            Any disclosures the Company provides will only cover the twelve (12) month period preceding the verifiable consumer request’s receipt. The response the Company provides will also explain the reasons the Company cannot comply with a request, if applicable. For data portability requests, the Company will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

(d)           The Company does not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If the Company determines that the request warrants a fee, the Company will tell you why it made that decision and provide you with a cost estimate before completing your request.

Section 18.         Other California Privacy Rights

(a)            California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of the Services that are California residents to request certain information regarding the Company’s disclosure of Personal Information to third parties for their direct marketing purposes. additional provisions applicable to Residents of the european union

Section 21.         Introduction.

(a)            If you are a resident of the European Union, the General Data Protection Regulation (“GDPR”) may provide you with additional rights regarding the Company’s use of your “personal data” (as defined in the GDPR and hereafter “Personal Information”). To learn more about your privacy rights, please review the following provisions of this Privacy Policy which act in conjunction with the foregoing provisions of Section 1 through Section 14 of this Privacy Policy.

(b)           The provisions of Section 21 through Section 23 of this Privacy Policy do not apply to Users who are not resident in the European Union.

Section 22.         The consent process

(a)            As part of the contracting process or at any time thereafter, you have the right not to consent to the processing of Personal Information, in the case of voluntary data processing, or to withdraw this consent at any time.

(b)           You always give your consent to the processing of Personal Information for a specific purpose.

Section 23.         Your Rights

(a)            In connection with the processing of your Personal Information, you have:

(i)             the right to clear, transparent and comprehensible information about how the Company uses your Personal Information and what your rights are (this Privacy Policy is also used for this);

(ii)           the right to access Personal Information and provide other information related to their processing;

(iii)         the right to correct incorrect and incomplete Personal Information;

(iv)          the right to delete your Personal Information, especially if they are no longer needed for further processing, you have revoked your consent to their processing, you have rightly objected to their processing, have been processed illegally, or must be deleted in accordance with legal procedures;

(v)           the right to restrict the processing of your Personal Information if you challenge the accuracy of Personal Information until the Company verifies their accuracy; processing is illegal; the Company no longer needs it, but you need the data for the purposes of asserting your legal claims; or object to their processing until the Company verifies whether the Company’s legitimate reasons outweigh your interests;

(vi)          the right to object to the processing of your Personal Information if the Company processes it for the purposes of the Company’s legitimate interests;

(vii)        the right to obtain your Personal Information and transfer it to another service provider; and

(viii)      the right to file a complaint with an applicable office.

(b)           If you believe that the Company is processing your Personal Information in violation of the protection of your private and personal life or in violation of the law, you may:

(i)             ask the Company for an explanation – see the contact details in Section 14; and

(ii)           demand that the Company eliminate the situation thus created – in particular, it may be a matter of blocking, correcting, supplementing or disposing of Personal Information.

If your request is found to be justified, the Company will immediately remove the defective condition.

 

(c)            If you want to obtain information about the Personal Information the Company processes about you, then please proceed as follows:

(i)             the Company will provide you with information on the basis of your written request, which you will send to the Company at the address noted in Section 14; and

(ii)           information about the processing of Personal Information of the data subject is sent by the Company only in writing, in the form of a registered letter to the address you provided in the application. Provide your contact details in the application. The Company has one month to process the application, with the possibility of extending this period in justified cases.

(d)           In the case of so-called voluntary processing, you are entitled to revoke the consents provided at any time. You can revoke the consent granted or, conversely, grant consent to the processing of Personal Information only in writing to the address indicated in Section 14.
